1. General provisions

1.1. Šios prekių pirkimo – pardavimo taisyklės (toliau „Taisyklės”), jas patvirtinus Pirkėjui (susipažinus su Taisyklėmis bei pažymėjus varnelę prie teiginio „Sutinku”), yra šalims privalomas teisinis dokumentas, kuriame nustatomos Pirkėjo ir Pardavėjo teisės bei pareigos, prekių įsigijimo bei apmokėjimo už jas sąlygos, prekių pristatymo ir grąžinimo tvarka, šalių atsakomybė bei kitos su prekių pirkimu – pardavimu elektroninėje parduotuvėje earomatas.lt susijusios nuostatos.

2. Protection of personal data

2.1. To order goods in the e-shop earomatas.lt, the buyer must register on this website by entering his registration name and password. By confirming these rules, the buyer agrees that the information notices necessary to complete the order of the goods will be sent to the e-mail address specified by him.

2.2. When ordering goods, the buyer must indicate the personal data necessary for the execution of the order: name, surname, delivery address of the goods, telephone number. The seller confirms that this data will be used exclusively for the purposes of selling goods in the e-shop earomatas.lt. The Seller undertakes not to disclose such information to third parties, except for the Seller's partners providing delivery of goods or other services related to the proper execution of the Buyer's order. In all other cases, any personal data of the Buyer may be disclosed to third parties only in accordance with the procedure provided for by the legal acts of the Republic of Lithuania.

3. The moment of concluding the purchase and sale agreement

3.1. Sutartis tarp Pirkėjo ir Pardavėjo laikoma sudaryta nuo to momento, kai Pirkėjas, išsirinkęs perkamas prekes ir suformavęs prekių krepšelį, susipažįsta su Taisyklėmis bei pažymi varnelę prie teiginio „Sutinku”.

4. Buyer's rights

4.1. The Buyer has the right to purchase goods in the e-shop earomatas.lt in accordance with the procedure established by these Rules.

4.2. The Buyer has the right to withdraw from the contract of purchase and sale of goods concluded with the e-shop earomatas.lt, notifying the Seller by e-mail info@earomatas.lt indicating the desired return of the product and its order number no later than within 30 (thirty) calendar days of delivery. days.

4.3. Taisyklių 4.2. punkte numatyta Pirkėjo teisė įgyvendinama vadovaujantis ūkio ministro 2001 m. rugpjūčio 17 d. įsakymu Nr. 258 patvirtintomis „Daiktų pardavimo ir paslaugų teikimo, kai sutartys sudaromos naudojant ryšio priemones, taisyklėmis”.

5. Obligations of the Buyer

5.1. The Buyer must pay for the goods and accept them in accordance with these Rules.

5.2. Pirkėjas įsipareigoja neperduoti tretiesiems asmenims savo prisijungimo duomenų. Jei Pirkėjas praranda prisijungimo duomenis, jis privalo nedelsiant informuoti apie tai Pardavėją skyriuje „Kontaktai” nurodytomis susisiekimo priemonėmis.

5.3. If the data provided by the Buyer in the registration form changes, he must update them immediately.

5.4. By using the e-shop earomatas.lt, the Buyer undertakes to comply with these Rules, other conditions and not to violate the legal acts of the Republic of Lithuania.

6. Seller's Rights

6.1. The seller has the right to set the minimum size of the shopping cart, i.e. the minimum amount at which the Buyer's order will be processed. The amount of this amount is visible when viewing the shopping cart, if the amount is too small to complete the order.

6.2. If the Buyer tries to damage the stability and security of the e-shop earomatas.lt or violates its obligations, the Seller has the right to immediately and without notice restrict or suspend the use of the e-shop earomatas.lt or, in exceptional cases, cancel the Buyer's registration.

6.3. In case of important circumstances, the Seller may temporarily or permanently terminate the operation of the e-shop earomatas.lt without notifying the Buyer in advance.

6.4. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Buyer, having chosen 8.2.1. or 8.2.2. do not pay for the goods within 3 (three) days.

7. Obligations of the Seller

7.1. The Seller undertakes to make available to the Buyer the services provided by the e-shop earomatas.lt under the conditions set forth in these Rules.

7.2. Pardavėjas įsipareigoja gerbti Pirkėjo privatumo teisę į jam priklausančią asmeninę informaciją, nurodytą elektroninės parduotuvės earomatas.lt registracijos formoje, išskyrus Lietuvos Respublikos įstatymuose ir „Taisyklėse dėl asmens duomenų apsaugos” nustatytus atvejus.

7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions specified in the Rules.

7.4. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer a similar or as similar a product as possible. If the Buyer refuses to accept an analogous or similar product, the Seller undertakes to return the money paid to the Buyer within 3 (three) business days, if the advance payment has been made.

8. Prices of goods, payment procedure and terms

8.1. The prices of the goods in the e-shop earomatas.lt and in the formed order are indicated in litas with VAT and delivery (for e-cigarette sets).

8.2. The buyer pays for the goods in one of the following ways:

8.2.1. When paying using the payment system mokejimai.lt.

8.2.2. Paying by bank transfer is an advance payment when the Buyer, after printing the order and going to the nearest bank branch, transfers the money to the bank account of the e-shop earomatas.lt.

8.3. When paying 8.2.1. and 8.2.2. the Buyer undertakes to pay immediately. In the above cases, in accordance with Rule 6.4. of the Seller's right provided for in paragraph 1, only after receipt of payment for the goods, the formation of the consignment of goods shall begin and the term of delivery of the goods shall begin to run.

8.4. Pirkėjui išsirinkus pageidaujamas prekes ir sudarius sutartį su Pardavėju (susipažinus su Taisyklėmis bei pažymėjus varnelę prie teiginio „Sutinku”), į jo nurodytą elektroninio pašto adresą bus atsiųsta išankstinio apmokėjimo sąskaita-užsakymas, o po apmokėjimo PVM sąskaita-faktūra. Sąskaitose nurodomos pasirinktos prekės, jų kiekis, suteikiamos nuolaidos, galutinė prekių kaina, įskaitant visus mokesčius, ir pristatymo mokesčiai.

9. Delivery of goods

9.1. Delivery of goods to the Buyer:

9.2.1. The buyer undertakes to indicate the exact place of delivery of the goods and to choose the time of delivery of the goods. It is especially important to indicate the correct postal code on the registration form, as it will be used by the courier to deliver the goods. For your convenience, a link to the Lithuanian Post Office page has been created in the registration form, where you can find out your code.

9.2.2. The buyer undertakes to accept the goods himself. In the event that he is unable to accept the goods himself and the goods are delivered to the specified address and on the basis of other data provided by the Buyer, the Buyer shall not be entitled to make claims to the Seller regarding delivery of the goods to the wrong entity.

9.2.3. The goods are delivered by the Seller or his authorized representative courier service - UAB Negė. The goods are delivered at a time agreed with the Buyer. The time of delivery is chosen by the Buyer when placing the order. In cases when the Buyer is unable to accept the goods within the set time, he undertakes to immediately notify UAB Negė: tel. no .: +370 700 55101.

9.2.4. The delivery (transportation) fee is calculated according to the place of delivery. In the whole territory of Lithuania, except Neringa, delivery costs 0 LTL (for a set of electronic cigarettes), in Neringa - 75 LTL.

9.3. The Seller delivers the goods to the Buyer in accordance with the terms specified in the purchase process. These terms are preliminary and do not apply in cases when the Seller does not have the required goods in stock and the Buyer is informed about the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to contact the Buyer immediately and agree on the conditions of delivery of the goods.

9.4. In all cases, the Seller shall be released from liability for violation of the terms of delivery of the goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Buyer's control.

9.5. Due to the fault of the Buyer or the circumstances depending on him, UAB Negė does not have the opportunity to deliver the goods, UAB Negė additionally coordinates a new delivery time suitable for the Buyer. Re-delivery shall be made no more than twice. If the buyer does not accept the goods for the first time, he has the right to pick up the goods himself at a place agreed with UAB Nege. Otherwise, if the Buyer does not accept the goods three times, the goods are returned to earomatas.lt, and the Buyer has no right to express claims regarding non-delivery of the goods on time.

9.6. At the time of delivery of the goods to the Buyer, the Buyer must together with the Seller or his authorized representative check the condition of the consignment and sign an invoice, bill of lading or other document of delivery - acceptance of the consignment. If the Buyer signs the invoice, bill of lading or other document of delivery - acceptance of the consignment, it is considered that the consignment has been delivered in proper condition. If the Customer notices that the packaging of the submitted consignment is damaged (wrinkled, wet or otherwise externally damaged), the Buyer must mark it on the invoice, bill of lading or other delivery-acceptance document and, in the presence of the Seller or his representative, draw up a free-form consignment violation report. If the Buyer fails to do so, the Seller shall be released from liability against the Buyer for damage to the goods, if such damage was caused by damage to the packaging, which the Buyer did not mark in accordance with the above procedure.

10. Product quality guarantee

10.1. The characteristics of each product sold by the e-shop earomatas.lt are generally indicated in the product description attached to each product.

10.2. The Seller is not responsible for the fact that the goods in the e-shop earomatas.lt may not correspond to the actual appearance of the goods due to the characteristics of the monitor used by the Buyer.

11. Return and exchange of goods

11.1. Parduotos kokybiškos prekės keičiamos, grąžinamos vadovaujantis ūkio ministro 2001m. birželio 29 d. įsakymu Nr. 217 „Dėl Daiktų grąžinimo ir keitimo taisyklių patvirtinimo” patvirtintomis Daiktų grąžinimo ir keitimo taisyklėmis.

11.2. Parduotos nekokybiškos prekės keičiamos, grąžinamos vadovaujantis ūkio ministro 2001m. birželio 29 d. įsakymu Nr. 217 „Dėl Daiktų grąžinimo ir keitimo taisyklių patvirtinimo” patvirtintomis Daiktų grąžinimo ir keitimo taisyklėmis.

11.4. 11.1. The Buyer may exercise the right provided for in the Clause of the Rules within 30 (thirty) calendar days from the date of delivery of the goods to him, informing the Seller thereof. 4.2. The procedure provided for in the paragraph of the Rules.

11.5. When returning the goods to the buyer, the following conditions must be met:

11.5.1. the returned product must be in the original neat packaging and placed in a protective transport box with the earomatas.lt symbol;

11.5.2. the goods must be undamaged by the Buyer;

11.5.3. the product must not have lost its commercial appearance (undamaged label, peel-off protective film, etc.);

11.5.4. the returned goods must be in the same configuration as received by the Buyer;

11.5.5. when returning the goods, it is necessary to submit the document of its acquisition and completed 11.3. The return document specified in the paragraph of the Rules.

11.6. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not follow the procedure for returning the goods set out in this Article.

11.7. The Seller collects the returned goods free of charge from the Buyer on working days from 10.00 to 17.00 using the courier services. When the received wrong product and / or defective product is returned, the Seller undertakes to pick up such goods and replace them with similar suitable goods. In the event that the Seller does not have similar goods, he shall return to the Buyer the money paid for the goods.

11.8. Prekių grąžinimas ir keitimas vykdomas vadovaujantis ūkio ministro 2001 m. birželio 29 d. įsakymu Nr. 217 patvirtintomis „Daiktų grąžinimo ir keitimo taisyklėmis” bei ūkio ministro 2001 m. rugpjūčio 17 d. įsakymu Nr. 258 patvirtintomis „Daiktų pardavimo ir paslaugų teikimo, kai sutartys sudaromos naudojant ryšio priemones, taisyklėmis”.

11.9. The amount paid shall be refunded no later than 15 days after signing the refund form. Amounts paid for the delivery of goods are not refunded to the Customer.

11.10. Special conditions apply to the return of goods during promotions and sales, which must be observed.

12. Liability

12.1. The buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences.

12.2. The buyer is responsible for the actions performed using the e-shop earomatas.lt.

12.3. The buyer is responsible for transferring his login details to third parties. If the services provided by the e-shop earomatas.lt are used by a third party who has logged in to the e-shop using the login details of the Buyer, the Seller shall consider this person to be the Buyer.

12.4. The Seller is released from any liability in cases where the loss arises due to the fact that the Buyer, notwithstanding the recommendations of the Seller and its obligations, did not read these Rules, even though he was given such an opportunity.

12.5. If the Seller's e-shop contains links to the websites of other companies, institutions, organizations or persons, the Seller is not responsible for the information or activities performed there, does not maintain, control and does not represent those companies and persons.

12.6. In the event of damage, the guilty party compensates the other party for the direct damage.

13. Marketing Measures Applied by the Seller

13.1. The seller may initiate various promotions of the e-shop earomatas.lt at its own discretion.

13.2. The seller has the right to unilaterally, without separate notice, change the terms of the shares, as well as cancel them. Any change or cancellation of the terms and conditions of the shares is only valid in advance, i.e. from the moment of their performance.

14. Exchange of information

14.1. The Seller shall send all notices to the e-mail address provided in the Buyer's registration form.

14.2. Pirkėjas visus pranešimus ir klausimus siunčia Pardavėjo elektroninės parduotuvės skyriuje „Kontaktai” nurodytomis susisiekimo priemonėmis.

15. Final provisions

15.1. These rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.

15.2. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these rules.

15.3. All disputes arising out of the application of these rules shall be settled by negotiation. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
